Surrogate Lapham gave a second hearing yesterday in the case of the
contested will of Wiley Eighmey of Oaks Corners. Mr. Eighmy
left his property to one daughter. Several other children are
contesting the will on the ground of undue influence.
Mary McCrone, widow of John G. McCrone, of Chapinville, has
petitioned Surrogate Lapham to revoke the probate of the will of her
husband by Surrogate Colmey in 1892. Mr. McCrone left the use of his
property to his widow, until her death or marriage, when the whole of
it is to go to their son, Francis, a boy of two years of age. Mrs.
McCrone alleges that her husband's mother, Thomas McCrone, his
executor, and others procured the execution of the will through fraud, John
McCrone not being capable of making a will at the time of its
execution.
The wills of the following persons have been probated this week: Anna
M. Paull, East Bloomfield , estate $6300; Henry Post, Manchester,
estate, $5000; Hannah S. Bennett, Farmington, estate $300; Zadoc
Warfield, Manchester, estate $6000. Letters of administration have
been issued to Garratt S. Preston, on the estate of James
McLaury, of East Bloomfield, and to Alice A. Gates on the
estate of Fordys Gates of Hopewell.

Alanson Jones in Trouble - From the Canandaigua
Repository-Messenger - Because he cannot, or has not, made
an accounting of his
proceedings as executor of his deceased father's $12,000 estate in
Geneva,
Alanson A. Jones of New York city is now testing the hospitable
accommodations of the Ontario County jail.
Augustus Jones of Geneva died November 30, 1884, leaving a will
in which $12,000 worth of real and personal property was left to
his six sons (among whom was Alanson), three daughters, a widow, Charity
Jones, and five grand-children. It was stipulated in the
Surrogate's Court January 21, 1886, by Alanson A. Jones, that while
letters testamentary were issued to him along with Mrs. Charity Jones,
the management of the estate during her lifetime should be entrusted to
her, pursuant to the
will.
After the death of Charity Jones in 1886, Alanson A., as surviving
executor, converted the property into cash. In the meantime, Carver
Jones, his brother, of Chesterfield, Ind., had transferred his
interest as one of the legatees to his wife, Rosaline. When
Alanson became sole executor, she wrote and asked him for her share of
the estate. He did not respond and November 14th last she
petitioned the Surrogate for an order summoning Alanson to account.
He was thereupon cited to appear at Geneva, December 21st. John
E. Bean, as attorney, appeared, asked for and was granted a continuance
til January 18th. Jones again failed to appear and then an order
was issued, requiring him to account. He failed and an attachment
was
issued, upon which the Sheriff arrested him at New York and returned
him
here for a hearing before Surrogate Lapham last Saturday. Jones
had
no counsel and was not in any way prepared to answer interrogatories.
Upon
his promise to do so tomorrow, he was remanded to jail.

The Tillotson Estate - A Canandaigua correspondent of the
Rochester Dem. & Chronicle has this to say about the
Tillotson estate in which our townsman, Mr. S. S. Mallory, as
nearest of kin to
his deceased sister, the intestate, has undoubtedly the greatest
interest:
Henry S. Hubbell and Fred W. Bryan, of Canandaigua, have been appointed
appraisers for the estate of the late Mrs. J. Adelaide Tillotson,
who recently committed suicide. The work of appraising began at
the late home of the deceased on Wednesday. It is said that many
things which she had in her house a short time before she died are
missing,
and it is intimated that some one has taken from the house since Mrs.
Tillotson's death. Among the articles reported to be missing are
about twenty pairs of linen sheets and pillow cases and jewelry.
The same authority says that Mrs. Tillotson made a will last
summer in which she provided
that her brother, Sidney Mallory, should have the rentals from two of
the
stores in the Tillotson block during his lifetime, and that upon his
death
the stores should go to Spencer Mallory, a nephew. A search for a
will has been thoroughly made, but up to the present time, such an
instrument has not been found. Mrs. Tillotson was seriously ill
at
one time last summer and it is intimated that the will might have been
taken
out of the house at that time. At any rate, there is bad blood in
the
camp and a legal fight will probably be the result.

H. Reed of Gorham was admitted to probate, amount not stated, and
no letters issued. The will of Helen S. Boughton, late of
Victor, was probated, and Bolivar Ellis appointed executor of
the estate valued at $4000. Mary Jane Rainsford was appointed
executor of the estate of Pratt Carpenter, late of Victor,
amount not stated; William R. Hutchinson and Sylvanus
Bafny, executors of the $4000 estate of Johnathan Hutchinson, late
of Seneca. The will of Clarkson Aldrich of Manchester,
bequeathing $300 worth of property was probated, but no letters were

of Mellicent Smithen, bequeathing a small estate, probated;
objections by heirs to the will of Matilda Burgher, late of
Canandaigua, were filed. The $5500 estate, aside from a few small
legacies, is left to the Woodlawn Cemetery association for the erection
of a mortuary chapel. Letters of administration were issued to Wm.
F. Harvey in the $2400 estate of Margaret Harvey, late of
West Bloomfield; to Amanda Felt and Carrie M. Lothridge in
the $100 estate of Chauncey W. Felt of Victor; to Margaret

E. Moore in the $700 estate of Margaret Thompson of
Geneva. To Endolpha C. Osterhout in the personal estate of John
M. Osterhout. A matter that has been in litigation some time past
and which will not be taken from Surrogate's jurisdiction is a case of
peculiar nature. Harlow Hinckley was appointed executor of the
$3000 personal estate of George Remington, late of Naples.
During the latter's lifetime he boarded with one Clara Benjamin, and
his effects, including his bank book, were at her house. The executor
endeavored to obtain possession of them and failing secured an order
from the surrogate requiring said Clara Benjamin to show cause why she
should not deliver up the belongings of deceased; in her formal answer
she alleges that she is the owner of the property in question. As this
is disputed the heirs will resort to a higher court. Letters of
administration were issued to Cyrus G. Bardeen in the $6000
estate of Emogene Bardeen of Naples.
