The fourth hearing in the contest of
the will of Henry J. Beatty was held yesterday in the
common council chamber before Surrogate George F. Ditmars.
Two witnesses, Henry Bourn and Dr. Henry D. Clapp, were
sworn
by
the
contestants.
Their
evidence
was
intended
by
counsel
to
show
that
the
late
Mr.
Beatty
was
inclined
to
ramble
in
his
conversation,
that
he
was flighty at times and therefore incompetent to make his will.
The next hearing will be Thursday.

In Surrogate Court held Saturday by
Judge Ditmars the will of the late William R. McKane was
admitted, making his daughter, Mrs. Florence A. Page, and
his son, William F. McKane, executors. The amount
of the estate was not given. Huntington Richards and George
Richards,
trustees under the will of the late Peter Richards, made
a final settlement of accounts. In the matter of
the will of the late Francis Brown, the petitioners failed
to produce sufficient proofs and the case was continued. Both
witnesses to the will are dead. The proofs of the handwriting
of the testatrix, which was her last, other than that attached to
the will, is in a deed of property sold to Dilman Brothers and locked
in the safety deposit vault at the German National Bank. Fred
Dilman, who is traveling in the South for his health, has the key,
and the deed cannot be produced for a comparison until his return
which is indefinite.

The will of Ann E. DeVoll, late of the Town of Seneca, was
admitted to probate this morning in
surrogate's court. The estate consists of $700 personalty.
The petitioner was William S. DeVoll of this city,
for whom Charles N. Hemiup appeared. The will was executed
May 11, 1894, and the witnesses were Charles N. Hemiup and Eva
Hemiup.
F. E. Clark filed a petition with Surrogate Ditmars this
morning for final settlement, as guardian, of the accounts of Harriet
P.
Coon
Heaven
and Arthur C. Coon. The petition
was granted and final settlement was filed by the surrogate.

The will of Mrs. Frances S. Brown, colored, late of 142
Castle street, who died Aug. 30 last, was probated in the surrogate's
court Saturday. The will was made Feb. 24, 1872, and both the
witnesses to the will are dead. As there was no one living who
knew the signature of the maker of the will except the legatees, it was
necessary to prove her signature by comparison. The witnesses of
the will were Hiram Close and Joseph H. Fulton. Mrs.
Florence A. Lewis, daughter of Hiram Close, swore to the signature
of the first witness, and William E. Hayes, said to be the
oldest resident of the city, testified to the signature of the second
witness to the will. The signature of Mrs. Brown was proven by
comparing it with her signature in a deed given to Dilman Brothers, two
years ago. The will disposes of an estate of $800 personalty and
the house at 142 Castle street. It names as legatees the three children
of the deceased, W. H. Brown, Albert Brown and Louise
Brown.

Objection to the probate of the will on the ground that the testator
was of unsound mind at the time the will was drawn and was therefore
incompetent. The will gives all the property of the decedent to the
children of her first husband, Barnes.

Surrogate Ditmars has declared that James W. D. Gahan, of
Geneva, is the sole heir-at-law of the late Bridget Gahan, who
died in this city Sept. 5, 1892. He will receive from the estate
a house and lot on Grove street. Henry Ludlow was
appointed special guardian of Wilson H. Buchholz, in the
matter of the settlement of the estate of the late Wilson
G. Hunt. The case was adjourned for two weeks. William G.
Dove, general guardian of Arthur G. Dove, was ordered to
pay
$244.52 in full settlement. A decree was ordered in the judicial
settlement of the accounts of Patrick Stapleton of Geneva,
executor of the last will and testament of the late James Hallahan.

morning. His widow, Almira M. Beach, was named

The will of John Broderick was probated yesterday.
It
disposes of a personal estate valued at about $1600 and real property
estimated to be worth $2000. Mrs. Ann Broderick, widow
of the testator is named executor. Edward H. Palmer, one
of the executors, of the will of the late Lemuel Herendeen, and
a
trustee
of
the
estate,
was
discharged
from
those
offices
on
his
own
petition
this
morning.
It
was
set
forth
in
the
decree that the
petitioner had not received any portion of the estate or any property
belonging thereto, and that Albert H. Herendeen, the remaining
executor and trustee, was competent to manage the estate.

The will of the late Thomas Beard has been admitted to
probate. The estate is valued at about $12,000, divided almost
equally in personal property and real estate. It is left in
entirety to his widow, Mrs. Alva Beard, who is executor of the
will.
The will of Emily Darrow, formerly of the Town of Seneca, has
also been admitted to probate. Miss Darrow received fatal
injuries
in a runaway last summer. The runaway was caused by an
automobile, a few miles west of the city. Charles H. Darrow, the
nurseryman

Mary Kelleher Sues Executors for Services for Mrs. Wright - The
suit of Mary Kelleher against O. J. C. Rose and Herbert
M.
Eddy,
executors of the will of Sarah Wright, who died
at
her home in Jay street, this city, in June 1901, was tried before
Referee, Fred L. Manning of Waterloo at the law office of George L.
Bachman yesterday. The suit is to recover $190 which the Kelleher woman
claims is due her for services in caring for Mrs. Wright during the
last year and half of the
latter's life. Action was brought in the supreme court and there
referred to F. L. Manning. George L. Bachman represented the plaintiff,
while A. P. Rose appeared for the defense. The case was adjourned until
July 17.

The will of the late Ernest W. Fox, who died September 8,
was admitted to probate this morning before Surrogate George F.
Ditmars. The petitioner, Herman F.
Fox, was appointed executor of the will. According to its
provisions, the estate will be divided into seven equal parts. One part
will be given to each of the children, Herman Fox, Lena A. Fink,
Emma G. Gilbert, Mary L. Sipple and
Louise M. Fox. One half a share is given to a grandson, Frank
Fox.
The remaining one and one-half shares is to be given to Herman
F. Fox to be held in trusts to apply on the support and education
of Ernest F. Fox
and Rubie M. Fox, minor grandchildren. When the
younger of the two minor heirs shall become of age, the one and
one-half shares shall be divided equally between them. The

The will of the
late Joseph W. Price, formerly of Naples, was admitted to
probate this morning by Surrogate George F. Ditmars. The will disposes
of an estate of $11,000 personal and $1500 real property. Arrajina
C. Price of Naples,
Josephine Mattice and Jessie F. Crosby of
Cohocton were appointed executors. On the testimony of
twelve witnesses which were sworn to this morning before Frederick D.
Whitwell, as commissioner, Mary McGloon of North street was
declared to be incompetent to manage her business matters,
and a recommendation was made that a committee be appointed to take
charge of her property. Mary McGloon, who the witnesses declare to
be feeble-minded since childhood, recently became heir to a third
interest in two houses and a vacant lot on North street, which share is
valued
at $827, with an annual income of $65.33. The witnesses who testified
were Arthur W. Sperry, Frank C. Hufmann, Watson F. Stubbs, William
H. Darling, M. A. Roberts, Fred G. Jaynes, Frank O. Kent, George E.
Huie,
Edgar Parker, Joel Page, Thomas Laws and Albert W.
Richards.

In Surrogate court this morning a hearing was had upon the judicial
settlement of the accounts of Frederick C. Wilkie, as
surviving administrator of the estate of Charlotte Wilkie. Gerry
Sackett appeared for the administrator, while S. S. Partridge of

for the Willard State hospital and filed claims against

In his will Mr. J. H. Pickett left his faithful
housekeeper, Mrs. Wilhelmina Fisher-Ringer $1200, and the
balance of his estate to his adopted daughter, Mrs. Fred T. Nester. Of
course, we do not know
the amount of his estate, but it is variously estimated at from $18,000
to $30,000.
