EXECUTORS' NOTICE -
Pursuant to an order of George R. Parburt, Surrogate of Ontario County, notice is hereby given to all persons having claims against the estate of Benjamin Cromwell, late of the town of Seneca, deceased, to exhibit the same with the vouchers thereof to John K. Cromwell and William R. Powers, Executors of the last will and testament of said deceased, at the residence of said John K. Cromwell in the town of Seneca aforesaid, on or before the first day of May next.   Dated October 22d, 1845.

Parburt, Surrogate of Ontario county, notice is hereby given to all persons having claims against the estate of Jesse Parshall, late of the town of Seneca, deceased, to exhibit the same with the vouchers thereof, to Charles H. In the Stephenson will case, opposition has been withdrawn, and the will admitted to probate.

Proceedings have begun in the case of the will of A. L. Van Dusen, late of Manchester, who died Nov. 7, 1878.  Mrs. Nancy J. Hawks, a sister of the deceased, is the contestant, alleging that the codicil in question, which materially modifies the will, was made only a few hours before her brother's death, when he was entirely incompetent.  T. M. Howell Esq., appears in behalf of the contestant, and John Callister, Esq., for the executors.  The case has been adjourned to March 10th.

February 4th, 1880 -- Estate of Anna Sawyer, deceased; citation issued to heirs-at-law and next of kin, to attend the final settlement of the account of Joseph N. Sawyer, on the 8th day of May, 1880.

Estate of Cornelius Vanderburgh, deceased. Phillip H. Vanderburgh, the executor of said deceased, having died leaving a portion of the goods of said deceased unadministered; upon petition.  Ordered that letters of administration, with the will annexed, be issued to Alida A. Humphrey and John B. Robertson.

February 11 --  In re the estate of Elizabeth S. Dunham, deceased; Lucius T. Dunham petitioned for the proof of the will of said deceased; thereupon a citation issued to the heirs at law and next of kin, to show cause, on the 1st day of March, 1880, why said will should not be admitted to probate.

February 12 -- In re the estate of Horace Dibble, deceased; the will of said deceased admitted to probate, and letters testamentary thereon granted to Walter Dibble, Royal H. Mowrey and Oliver H. White were appointed appraisers of said estate.

In re the estate of Elizabeth A. Rose, deceased; Stephen J. Tallmadge petitioned for the proof of the will of said deceased; thereupon a citation issued to the heirs at law and next of kin of said deceased, to show cause, on the 23 day of Feb. 1880, why said will should not be admitted to probate.

In re the estate of Amy A. Lapham, deceased; D. G. Lapham, Esq., petitioned for the proof of the will of said deceased, and a waiver of citation was filed; thereupon a commission was issued to David B. Lyman, Esq., of Chicago, to examine John W. Cridgman and James B. McChesney in support of the proof of said will.

February 16 --  In re the estate of Thomas A. Carson, deceased; Isabella W. Carson and Thomas B. Wilson petitioned for the proof of the will of said deceased and a waiver of citation was filed; thereupon due proof was made and said will was admitted to probate, and letters testamentary thereon were granted to said petitioners.  Charles Rice and John C. Wilson were appointed appraisers of said estate.

In re the estate of James Stephenson, deceased; the will of said deceased having been heretofore admitted to probate by Hon. Wm. S. Briggs, surrogate of Yates county, acting as surrogate of Ontario county, letters testamentary on said will were this day granted to Spencer D. Short and Willard P. Smith.

In re the estate of Horatio Wheeler Bostwick and Anna A. Bostwick, minors over 14 years of age; the minors above named petitioned this Court that John A. Reed, of Richmond, might be appointed their guardian; and said John A. Reed having filed his bond with the required sureties, letters of guardianship of said minors were granted to him.

The will of Geo. Renwick, late of Seneca, has been admitted to probate, and letters testamentary thereon granted to Jas. N. Renwick, son of the deceased.

The will of the late Mr. John Johnston of Geneva has been admitted to probate. Dr. Geo. N. Dox and E. H. Hurd, Esq., are the subscribing witnesses thereto. It names his son-in-law, R. J. Swan, Esq., and his daughter, Miss Hope Johnston, as executors. Messrs. A. L. Chew and E. B. Richardson are appointed appraisers of the estate.

In the matter of the estate of Geo. Proudfit, late of Jackson, Mich., deceased, (who has assets in this county), letters of administration have been granted to his brother, Charles H. Proudfit of Seneca. Yesterday the heirs and next of kin of the late Thomas Vandevort of Phelps were to appear upon citation before the Surrogate to attend the probate of Mr. V.'s will. Louisa Knapp and Stalham Crittenden have been granted letters of administration on the estate of John Knapp, deceased, late of Phelps.

The will of the late James Day of Geneva has been admitted to probate, and letters testamentary issued to his widow, Susan, and son, J. W. Day.

The following is a report of the proceedings in the Surrogate's Court for the past week:

Jan. 28 - In the matter of the estate of Thomas M. Biddlecome, late of Phelps, deceased. Citation issued to creditors and next of kin to attend the judicial settlement of the accounts of John B. Haynes, as administrator of said estate on the 15th day of February, 1881 at 10 o'clock a.m. In the matter of the estate of John Johnston, late of Canandaigua, deceased. Administration on said estate awarded to Samuel Johnston and John Johnston, and Hiram Tiffany and Frederick A. Sackett appointed appraisers of said estate. In the matter of proving the will of Betsey Spencer, late of Canandaigua, deceased. Citation to the heirs-at-law and next of kin to said decedent, to attend the probate of her will on the 28th day of March, 1881, at 10 o'clock a.m. In the matter of the estate of John Rankine, late of Canandaigua, deceased. William G. Antis and Evander Sly appointed appraisers of said estate.

Jan. 31 - In the matter of the estate of Francis E. Baxter, late of Hopewell, deceased. Administration on said estate awarded to Cyprian H. Baxter and Charles G. Hemenway, and John S. Coe, and Mattison L. Parkhurst appointed appraisers of said estate. In the matter of proving the will of William Perkins, late of Seneca, deceased. Will admitted to probate on the evidence of William Pulver, sole surviving witness to said will, and Frank Rice, who identified the signature of said testator, and letters testamentary on said will granted to Clarence W. Perkins, executor named in said will.

Surrogate's Court -
The following are the proceedings of the Surrogate's Court for the past week:

Feb. 4 - Estate of Thadeus A. Lawrence of Canandaigua. Ordered that Henry C. Lawrence personally appear before the Surrogate of Ontario County on February 9, 1881, and render account as administrator of said estate.

Feb. 5 - Estate of Asenath Adams of Victor. Matter postponed until March 5, 1881. Estate of Frederick Westbrook of Canadice. Citation issued to next of kin to show why Walter Westbrook, son of deceased, should not be awarded administration of said estate. Estate of George H. Adsit of Phelps. Citation issued to all parties interested in estate to attend settlement of Levi B. Ferguson, ex'r, on March 22, 1881.

Feb. 7 - Estate of Harriet A. Norton of Victor. Citation issued to heir to attend probate of will on Feb. 15, 1881.

Feb. 8 - Person and estate of George W. Heath, of Victor, a minor. Letters of guardianship issued to David Heath. Judicial settlement of the estate of John C. Sterling, of West Bloomfield. Ordered that M. N. Clement, Esq., be appointed special guardian of minors interested. Judicial settlement of the estate of Jos. Reed, of Seneca, decd. Citation to parties interested to attend such settlement March 8th, at 10 o'clock a.m. Will of Sarah Porter, of Phelps, decd. Ordered that a citation issue to next of kin of deceased, to show cause why petition for appointment of Abram S. Smith as administrator should not be granted.

Feb. 9 - Will of John Hart of Hopewell. Order for substituted service on certain of the heirs at law of deceased.

Feb. 10 - Judicial settlement of the estate of Cornelius Horton, late of Phelps, deceased. Ordered that a citation issue to parties interested returnable at a day in April not yet named.

The will of the late Alphonso Whedon of this town has been admitted to probate. Capt. J. S. Dorman received letters testamentary. Charles Rice and Anthony Jackson were appointed appraisers.

Mrs. Gibson's Will -
The will of the late Mrs. Sarah Gibson, which was recently admitted to probate, all objections having been withdrawn, bequeaths property amounting to $135,000 as follows: to Olivia M. Talcott, of Albany, $3000; to Charles A. W. Sherman, of Canandaigua, $4000; to Charlotte, his wife, $5000; to Miss Almira Tichenor, of Canandaigua, $1000; to Henry L. Lansing, of Buffalo, $2000; to Ellen Clohassy, servant, $100; to St. Johns Church, Canandaigua, $500; to Mark H. Sibley, of Buffalo, $2000; a house and lot on Park street, and $1000 to keep the same in repair, taxes, &c., to Evander Sly in trust for John S. Gibson. The residue of the property is left to Catherine Lansing, a daughter of decedent, of Buffalo.
