I, Samuel E. Rood being of sound mind and memory, do hereby make ordain and publish this my last will and testament.  And I hereby nominate, constitute and appoint Sheldon Squires my father-in-law and Hannah S. Rood, my wife, the executor and executrix of this my last will and testament, and I do hereby give, grant and devise to them the said Sheldon Squires as such Executor and the said Hannah S. Rood as such Executrix, all and every the real Estate, chattels real, and every ??? any interest in real estate to me belonging, and do hereby invest them with full power and authority to mortgage , sell, lease or otherwise dispose of my real Estate, chattels real and real estate interests or any portion thereof, after my decease, in Their discretion, as fully, completely and absolutely as I myself might do while living.

    And I do hereby give and bequeath to my said wife the sum of nine hundred (900.00) dollars That being about the same received by me from her and by her loaned to me after the period of our marriage and I hereby direct that if, after the payment of my just debts, sufficient of my personal property and the proceeds thereof remain to pay her the said sum, enough of said property or proceeds be applied to pay this same, it being my intent and desire that my real estate be not resorted to for the payment of the sum until my personal estate is exhausted.

    It is my will and wish and I do hereby ordain and direct that after paying my just debts and the aforesaid legacy and bequest, the residue of my personal estate and the proceeds thereof and of the proceeds ??? of my real estate and the sale thereof be divided and distributed between and among my said wife and my children in the same manner as it would by law be divided and distributed in the absence of a last will and testament. 

    In ??? thereof I have hereinto set my hand and seal this 7th day of May 1861.

Subscribed by Samuel E. Rood the testator named in the foregoing will and at the time of making such subscription declared by the testator to be his last will and testament and each of us signs his name as a witness at the end of the will at the request of the testator and in his presence.

Surrogates Office, is recorded the proceeding last will and testament of Samuel E. Rood late of said county deceased as will of real and personal Estate, together with the proofs taken in the Surrogates Court of the County of Cattaraugus relating to said will.

    Which record is hereby signed and certified by me, pursuant to the provisions of the revised Statutes, This 21st day of May 1861
