Will of Franklin Rowley


In the Name of God.  Amen.

 I, Franklin Rowley of Victor, New York, aged seventy six years, being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do therefore make, publish and declare this to be my last Will and Testament, that is to say:

 First. - After all my lawful debts are paid and discharged, I give and bequeath and devise all the remainder of my Estate, Real, Personal and mixed to my six sons, Calvin Rowley, Charles A. Rowley, William W. Rowley, Frank Rowley, Clarke B. Rowley and George D. Rowley, to be divided Equally among them my said six sons, share and share alike.  I have advanced some money to my said son William W. Rowley of which I have an account on my account books and of the condition and nature of such account my Executors of this my last will and testament hereinafter named are perfectly familiar.  That account I hereby order shall be part of the body of my said Estate and the amount due thereon shall be taken from the distributive share of my said son William W. Rowley on the division of my said Estate.  My said son William W. Rowley also owes my said son Charles A. Rowley, being for the payment by him said Charles A. Rowley of one promissory note for $155.00 given to Ernest R. Reed by said William W. Rowley and  of which said note said Charles A. Rowley was an accomodation undersigner.  I hereby order my said Executors to reimburse said Charles A. Rowley for both principal and interest on account of his payment of said note and they shall deduct the said amount so paid to said Charles A. Rowley from the said distributive share of said William W. Rowley in my said Estate and I hereby make the payment of such debt a charge upon said distributive share of said William W. Rowley.  Said William W. Rowley shall receipt to my said Executors for the payment of the full distributive share upon their payment and delivery to him of the remainder thereof after deducting the amounts above provided to be otherwise paid and his execution and delivery of such receipt to my said Executors shall be a condition precedent to his receiving from them the said balance of his said distributive share in my said Estate.

 Likewise, I make, constitute and appoint my sons Calvin Rowley and Charles A. Rowley to be the executors of this my last Will and Testament, hereby revoking all former Wills by me made.

 In Witness Whereof, I have hereunto subscribed my name and affixed my seal, the 3rd day of May, in the year of our Lord one thousand eight hundred and ninety-eight.
