In the name of God, amen: I, Joseph Wilder of the town of
Bristol
in the county of Ontario and State of New York being of sound mind and
memory, do make and publish this my last Will and Testament as follows,
viz.
1st I give devise and bequeath unto my beloved wife Charlotte
Wilder the use and occupation of one equal third part (quantity and
quality
relatively considered) of all my real estate situated in the town of
Bristol
aforesaid, to hold to her the said Charlotte during the term of her
natural
life: and I further give and bequeath to my said wife Charlotte,
two hood cows, ten good sheep, and all the household furniture of which
I may die possessed.
2d To my sons Peter Wilder and James Wilder, and to my daughter
Lucinda Ganyard, I give and bequeath the sum of one dollar each, to be
paid to them by my executors within one year after my decease, out of
any
funds which may come into their hands.
3d The residue of all my real and personal estate of whatever
name or nature, I give devise and bequeath to my five children
hereafter
named, viz. Collins Wilder, Joseph Calhoun Wilder, Roena Kellogg,
Hannah Wilder and Nancy Wilder, to be divided among them as
follows.
To each of my sons Collins Wilder, and Joseph Calhoun Wilder, one third
part of the said residue of my estate, the other one third I would have
equally divided among my three daughters, Roena, Hannah and Nancy, to
be
paid to them severally as they arrive at the age of twenty-one years,
excepting
Roena Kellogg’s share, which is to be paid within five years after my
decease:
and Hannah Wilder’s share which it is my will shall be paid to my wife
Charlotte Wilder, and applied by her at her discretion for the benefit
of my said daughter, Hannah Wilder.
4th In order to provide means for the payment of any debt which
I may owe at the time of my decease, in the event that my personal
property
shall not be sufficient for the purpose, exclusive of the household
furniture
bequeathed to my wife Charlotte, I do hereby authorize and empower my
executor
hereinafter named, or the survivor of them, to sell at their discretion
such part of the real estate of which I may die seized, as may be
necessary
for the purpose aforesaid, and on making such sale, to convey the land
sold, to the purchaser or purchasers thereof, by a sufficient deed of
conveyance.
5th I hereby revoke all former wills made by me, and appoint
my friends William T. Codding of the town of Bristol, and Ira Wilder of
the town of Canandaigua executors of this my last will and testament.
In witness whereof, I have hereunto set my hand and seal this seventh
